[0:00] We're both fine.
[0:01] >> Please,
[0:02] as someone who was once your friend, let
[0:04] me die in peace.
[0:09] >> Tonight, put away your operation board.
[0:11] How local doctors are going high-tech to
[0:13] practice dangerous surgery.
[0:16] Restaurant owners say someone stole from
[0:18] them and knew right where to get the
[0:19] cash. Only on 12, the quick trick
[0:21] someone pulled that has workers baffled.
[0:25] She went to work at a local fast food
[0:26] restaurant, but says she left that day a
[0:28] rape victim.
[0:29] >> I can't believe that she can't go to
[0:31] work and something like this can happen
[0:32] to
[0:32] >> New details about the co-worker accused
[0:34] of assaulting her.
[0:35] But first, a Mother's Day tragedy. A boy
[0:38] accidentally killed in his own home.
[0:41] >> I wouldn't want wish this up on anybody.
[0:42] >> How police say you can prevent the same
[0:44] thing from happening. First on Fox.
[0:48] >> Live from Fox 12 Oregon, this is
[0:50] breaking news.
[0:52] >> Good evening. We do begin tonight with
[0:53] some breaking news.
[0:54] >> The Salem Police Bomb Squad is
[0:56] investigating a suspicious device at a
[0:58] mall. It's happening right now at Salem
[1:00] Center Mall. KPTV's Mark Hanrahan is
[1:02] live on the scene with the latest. Mark.
[1:04] >> Well, Wayne, we can tell you just within
[1:05] the last 5 minutes or so, police took
[1:07] down the crime scene tape here on the
[1:09] corner of Chemeketa and Liberty Street.
[1:10] Within the last half hour or so, they
[1:12] detonated what they're describing as a
[1:14] small brown suitcase that was left in
[1:16] the parking lot. We were there as they
[1:18] detonated that. Our cameras were
[1:20] rolling. Take a listen.
[1:28] Now, this all started at around 7:55
[1:30] this evening when 911 dispatchers
[1:32] received a call from a woman parked at
[1:34] the mall. She said that when she
[1:36] returned to her car from the mall, she
[1:37] found an 18-in by 20-in brown suitcase
[1:40] by her car that was not there when she
[1:42] parked. That's when Salem Police's Bomb
[1:44] Squad came out to the scene to examine
[1:45] the situation. As we mentioned earlier,
[1:47] officers detonated a charge, rather, to
[1:50] disrupt that suitcase. And right now,
[1:52] they're investigating what's left of it
[1:54] to determine exactly what it was. In the
[1:55] meantime, police have evacuated part of
[1:58] the mall parking lot along with J.C.
[1:59] Penney and McGrath's Fish House as well
[2:01] as blocking off several of the nearby
[2:03] streets. Back out here live, we will
[2:05] continue to monitor this situation in
[2:06] downtown Salem and bring you the latest,
[2:07] but for now, reporting live in Salem,
[2:09] I'm Mark Hanrahan, the 10:00 news.
[2:11] >> Okay, stay with Fox 12 for continuing
[2:13] coverage of the story. If anything
[2:14] changes, we will bring you an update
[2:16] tonight at 11:00 or online at kptv.com.
[2:19] >> Now, a Mother's Day heartache after a
[2:21] 12-year-old boy died in an accidental
[2:23] shooting and police say the gun that
[2:25] killed him was family owned. It all
[2:27] happened yesterday in Hammond near
[2:29] Astoria. Police say a bullet from a .22
[2:31] caliber pistol struck and killed Austin
[2:33] Wesley and tonight crisis counselors at
[2:36] his school are helping classmates deal
[2:38] with the loss. KPTV's Mark Frost has
[2:40] been following the story all day. He
[2:42] joins us live from Warrenton now with
[2:44] the latest, Mark.
[2:45] >> And cops here in Warrenton say they,
[2:47] along with most agencies in the state,
[2:49] hand out gun locks like this for free.
[2:51] Tonight, they want to encourage anyone
[2:53] who owns a gun to use them, along
[2:55] especially parents.
[2:57] Police and deputies responded to a call
[2:59] at this home just before 10:00 yesterday
[3:01] morning. They found 12-year-old Austin
[3:04] Wesley. Police say he accidentally shot
[3:06] himself with a pistol his family owns.
[3:09] It seems everyone in this tiny town
[3:11] knows what happened.
[3:12] >> No, it's it's it's tragic. I feel feel
[3:14] very bad for him. It's terrible.
[3:16] >> Cops are still investigating just what
[3:18] happened, but say foul play was not a
[3:21] factor.
[3:21] >> I wouldn't want wish this up on anybody.
[3:24] >> Today, Warrenton Grade School provided
[3:26] counselors and a safe room to grieve.
[3:29] Students made cards and shared memories
[3:31] of Austin.
[3:31] >> He was a pretty good friend and I knew
[3:33] him pretty well.
[3:35] >> Jason Miller was playing with his family
[3:37] this afternoon, but said he spent much
[3:39] of the day remembering his friend. The
[3:41] 11-year-old says he's struggling to cope
[3:43] with what happened.
[3:44] >> Well, I walked into school and everybody
[3:46] was like quiet and a few people were
[3:48] crying.
[3:49] >> Warrenton Grade School activated its
[3:50] crisis team to help kids and
[3:53] deal with the sudden death of one of
[3:55] their classmates. The principal says
[3:57] Austin was well-liked and will be
[3:58] missed.
[3:59] >> He was a funny and
[4:02] we hung out a lot.
[4:04] >> One father we talked to says he owns a
[4:05] gun, but does his best to keep it safe
[4:08] from his two young daughters.
[4:09] >> Cuz what's at stake by doing that kind
[4:10] of stuff?
[4:11] >> Oh, a child's life.
[4:13] >> Police in Warrenton give out gun locks
[4:15] like this for free. Tonight they want to
[4:17] remind every gun owner, especially
[4:19] parents, to keep their weapons safely
[4:21] locked up. They recommend storing guns
[4:24] and ammunition in separate places and to
[4:26] have a trigger lock or another locking
[4:28] mechanism on any weapons.
[4:30] >> Could be the difference between saving
[4:32] someone's life or a senseless tragedy.
[4:35] >> Right. How much you going to miss him?
[4:36] >> A lot.
[4:37] >> Austin's friend Jason Miller has a
[4:39] message for people who own weapons.
[4:40] >> I don't want their kids play guns.
[4:44] >> And back here live at Warrenton Grade
[4:45] School where the principal says they'll
[4:47] have counselors available for students
[4:48] throughout the end of the week.
[4:50] Reporting live tonight in Warrenton,
[4:51] Mark Ross, the 10:00 news.
[4:54] >> Police say St. Helens man accused of
[4:55] shooting and killing his neighbor over
[4:57] the weekend is cooperating with their
[4:59] investigation. Todd Marchant appeared in
[5:01] court today by video to face murder
[5:03] charges. He's been in custody since
[5:05] Saturday night when police say he shot
[5:07] Everett Brierly in the chest. Neighbors
[5:09] say the two men had been golfing
[5:10] together earlier in the day, but by that
[5:13] night they say the two men were drinking
[5:15] and fighting. Marchant went with
[5:17] investigators to the crime scene
[5:18] yesterday. Today the victim's family
[5:20] says they've suffered a great loss.
[5:23] >> It's just a sad tragic thing. Now that
[5:25] my my sister and my nephews don't have
[5:27] a, you know,
[5:29] a husband or
[5:30] a father.
[5:31] It's hard enough to say. It's just It's
[5:33] sad and just tragic.
[5:36] >> Marchant is being held without bail. He
[5:38] will be back in court on May 26th.
[5:40] >> A Stevenson man accused in the shooting
[5:42] death of his wife is behind bars tonight
[5:44] with his bond set at a million dollars.
[5:46] Skamania County Sheriff deputies say
[5:48] that Darcy Banazek called a relative to
[5:51] tell them what he'd done. When deputies
[5:54] arrived at the couple's home, they found
[5:55] his wife's body in the bedroom.
[5:57] Investigators say that he shot her on
[5:59] May 8th in a fit of rage. He was in
[6:01] court today as a judge set his bail.
[6:03] He'll be formally arraigned in court on
[6:05] Thursday.
[6:06] The prosecution came out on top as the
[6:08] trial for the murder of Chester Young is
[6:10] about to begin. This morning, a
[6:12] Multnomah County Circuit Judge ruled
[6:14] there is enough evidence to show the
[6:15] store clerk died of a gunshot wound, not
[6:19] neglect of care at a nursing home. In
[6:21] 2007, Jimmy Kashi shot Young while he
[6:23] worked at the Belmont Market. He died 17
[6:26] months later. Three others now face
[6:29] murder charges.
[6:30] >> A local man is accused of assaulting one
[6:31] of his coworkers at a Milwaukee fast
[6:33] food restaurant. A woman says the man
[6:35] raped her at the Wendy's along Southeast
[6:38] McLaughlin, and tonight he's sitting in
[6:40] jail. KPTV's Chad Carter talked to the
[6:42] mother of his accuser and joins us live
[6:44] from Milwaukee with the story, Chad.
[6:46] >> Yeah, and Shauna, deputies are saying
[6:47] tonight that it is this man who's
[6:49] accused of attacking and raping the
[6:51] woman. And tonight, while the victim's
[6:53] mother did not want to be identified,
[6:54] she is speaking out about a crime she
[6:57] says could have been prevented.
[6:59] >> It makes me really angry if she told the
[7:01] manager then he should not be there
[7:02] right now and this would have not
[7:03] happened.
[7:03] >> Words of rage from a mom who on Mother's
[7:05] Day learned her daughter had been
[7:07] brutally attacked while she worked at a
[7:09] local fast food restaurant.
[7:10] >> Just anger. Just anger that he thinks he
[7:12] had the right to do something like that.
[7:14] And apparently, he thought he was going
[7:16] to get away with it if he didn't even
[7:17] bother leaving the scene, you know, the
[7:18] incident.
[7:19] >> Deputies say sometime yesterday
[7:20] afternoon, Avoni Voldoe Alejo Sebastian,
[7:23] a coworker of the victim, went into the
[7:26] Wendy's bathroom while the victim was
[7:27] inside and raped her. Clackamas County
[7:30] deputies interviewed the accuser and
[7:32] witnesses and soon after arrested Alejo
[7:35] Sebastian, who by video conference made
[7:36] his first court appearance this
[7:38] afternoon, using a translator to hear
[7:40] the charges against him.
[7:42] >> She's been independent, you know, she's
[7:43] making her own money and you know, she
[7:45] really liked working there. She, you
[7:46] know, for the most part like the people
[7:47] and
[7:49] you know, until now.
[7:50] >> The victim's mother says she didn't know
[7:52] it until yesterday, but says there had
[7:53] been previous attempts to hurt her
[7:55] daughter.
[7:56] >> Apparently in the last couple of weeks,
[7:57] um
[7:59] some things have happened that led up to
[8:00] this.
[8:01] >> Clackamas County deputies confirm an INS
[8:03] hold has been placed on Alejo Sebastian
[8:06] as they look into whether he is in the
[8:07] country legally or not. Something that
[8:10] doesn't sit well with the victim's
[8:12] mother.
[8:12] >> I'm not going to sit here and um be
[8:14] quiet about something like this. People
[8:15] need to know what's going on and if um a
[8:17] restaurant has illegal aliens working
[8:19] there, then people need to know what's
[8:20] going on.
[8:21] >> Tonight, Alejo Sebastian sits in the
[8:22] Clackamas County jail facing charges of
[8:25] rape and sexual abuse with a $250,000
[8:28] bail.
[8:29] >> But I hope, you know, uh
[8:31] you know, justice is served.
[8:33] >> Now, for enter
