[0:00] First nations because they go way over

[0:01] the line. We reported a church in Texas

[0:04] that was actually writing checks from

[0:06] the church to the local Republican

[0:08] party. When asked about it, they said,

[0:09] "Oh, we thought we were subsidizing a

[0:11] golf tournament." Come on. People know

[0:13] what they're doing. Ministers know what

[0:15] their purpose is. If it's to talk about

[0:17] moral issues, you and I don't have a

[0:19] fight. If the they cross the line,

[0:21] Democrats or Republicans, they ought to

[0:24] be penalized under the law as it is.

[0:26] >> One minute. The the problem is, Barry,

[0:28] of all the investigations that you guys

[0:30] beg the IRS to get involved in, let's

[0:32] say in the 2004 election cycle, it's

[0:35] important to point out not a single tax

[0:37] exemption status was taken from a

[0:39] church. Not a single fine was imposed.

[0:41] So churches understand the limitations.

[0:43] Pastors in their individual capacities

[0:45] can endorse candidates all day long.

[0:46] >> Let me ask you uh Reverend Lyn, is it a

[0:48] question of where uh the actual

[0:50] proximity is? Is is are you talking

[0:52] specifically about the pulpit? What if

[0:54] that particular church leader happens to

[0:55] speak uh outside of his church or on

[0:58] church on church grounds?

[1:00] >> No. If the person is talking on

[1:02] television or if he forms along with

[1:04] other pastors a political action

[1:05] committee, pastors have done that in

[1:07] Wisconsin for example, they're entitled

[1:09] to the protection of the law that

[1:11] guarantees them under those

[1:12] circumstances the right to speak out.

[1:15] But if you use the resources of your

[1:17] church, if you use the power of the

[1:19] pulpit, if you use the collection plate

[1:22] money for political purposes, that's

[1:24] when you get in trouble. And frankly,

[1:26] that's where you ought to get in trouble

[1:28] because it's a good thing that we have

[1:29] all these taxexempt organizations that

[1:32] have only one constraint, and that is

[1:34] don't get involved in hard ball

[1:36] politics. Do anything else that you want

[1:38] to do, and you're not going to get in

[1:40] trouble. The IRS, by the way, is

[1:42] cracking down in this election cycle

[1:44] more than in 2004. They did, in fact, in

[1:47] 2004 visit churches. They got letter

[1:50] agreements saying, you know, we won't do

[1:52] this again. But this year, in 2006, I

[1:55] hope that the penalties come down in a

[1:57] harder and clearer way because this is

[2:00] no business of the church.

[2:02] >> You want to intimidate and silence your

[2:03] political opposition because you have a

[2:05] left.

[2:05] >> Is that why is that why I turn in? Is

[2:08] that why that Americans United reports

[2:11] Democratic churches, independent

[2:13] churches, and Republican churches?

[2:16] Because we've got

[2:17] >> gentlemen, I have to jump in here. The

[2:19] debate rages on. Certainly one that's

[2:21] very stimulating and something that

[2:23] we're going to be following for quite

[2:24] some time. Thank you very much for

[2:25] joining us today on the Live Desk.

[2:27] >> Thank you. Thank you.

[2:28] >> And coming up next on the Live Desk,

[2:29] Democrats are getting ready to take

[2:30] control in Washington. Now we know what

[2:33] they have planned. Coming up, what can

[2:34] Nancy Pelosi accomplish in her first 100

[2:37] hours? A dangerous storm slamming parts

[2:39] of the country. An update for you with

[2:42] the weekend travelers coming up next.

[2:45] >> Tito Ortiz Ultra Fighting Championship.

[2:47] All the troops know who I am. Thanks for

[2:49] your support, guys. We couldn't be

[2:50] walking around this awesome world we

[2:52] call United States of America. Thanks to

[2:54] you guys.

[2:57] >> I'm Stephanie Asino and this is my

[2:58] story. I come to people's homes and I

[3:00] wrap their Christmas and Hanukkah

[3:02] presents for them. People will call me

[3:03] up, can you come over and it'll be

[3:05] Christmas Eve? and I'm smiling and

[3:07] singing Christmas carols. I want to make

[3:09] their holiday look good. I have u

[3:12] arthritis in my back. I sit for long

[3:14] periods of times hunched over. It's a

[3:16] real strain. No one wants to see a

[3:17] holiday grimace. I take a leave later.

[3:19] I'm just not in pain. And then I go,

[3:21] "Oh, that'll leave. It worked again."

[3:22] The real reward is that at the end of

[3:24] it, I'm still smiling. That's the best

[3:26] part for me.

[3:27] >> Look closely at how dramatically these

[3:29] wrinkles diminish, seeming to disappear

[3:32] with just one application of Genosphere

[3:34] with Qzones. When doctors saw these

[3:37] results, they were astonished.

[3:39] >> I haven't seen anything like it since

[3:40] Botox, and the clinical evidence is

[3:42] clear.

[3:43] >> This is what my patients want. Dramatic

[3:45] results you can see immediately on the

[3:48] eyes, the lips, even the cheeks.

[3:50] >> And it's available without a

[3:52] prescription.

[3:53] >> Jennisphere's patented, clinically

[3:54] tested ingredients work like no other

[3:57] anti-rinkle formula can. Not Chanel, not

[3:59] Lancome, not even Botox.

[4:02] >> They took my picture and put this cream

[4:04] around my eye. I went to lunch and when

[4:06] I got back, just look the lines, the

[4:09] wrinkles. I don't see them anymore.

[4:11] >> Apply it each morning like your normal

[4:13] moisturizer. Genosisphere's patented

[4:15] microscopic carriers called Cuz bring

[4:17] absorbent hyaluronic spheres deep into

[4:20] the epidermis where they nestle beneath

[4:22] each wrinkle. Then, absorbing your

[4:24] body's natural moisture, they expand and

[4:26] gently lift wrinkles from beneath. With

[4:28] daily use, a woman could look years

[4:30] younger than her age for life. Many of

[4:33] my patients come to see me to avoid

[4:35] surgery. With Genisphere, they can

[4:37] affect the appearance of age lines and

[4:39] crows feet without surgery or

[4:42] injections.

[4:42] >> This revolutionary formula actually

[4:44] lifts wrinkles from beneath.

[4:46] Genosisphere is already selling for $99.

[4:49] But if you call right now, you'll find

[4:51] out how to get a month's supply of

[4:52] Genisphere absolutely free. You will see

[4:55] dramatic results, usually with the very

[4:58] first application.

[4:59] >> The results are quite dramatic. You see

[5:02] a difference with the very first

[5:03] application. Jenniser works because it's

[5:05] backed by real science with real

[5:07] results. Please do not delay.

[5:21] Genesis at 1800711-5917.

[5:27] >> Hi, I'm Katherine Herage. Right now,

[5:29] more than 7,000 women are serving in

[5:31] Iraq, many with honor and distinction

[5:33] this Saturday at 4 Eastern. We'll go

[5:35] in-depth and tell you the story of

[5:36] 27-year-old Don Haler, a West Point grad

[5:39] who led a platoon of military police in

[5:41] Bakuba, Iraq. She says it's a war that

[5:43] cannot be fought without women who often

[5:45] take on roles that are not part of their

[5:47] job description.

[5:50] I saw a lot of combat and you know,

[5:52] we're the rules the rules may say or

[5:55] Congress may say women are not in

[5:56] combat. Um, but the reality for me was

[6:00] that that I was. And you know, I know a

[6:02] lot of women that that are.

[6:04] >> There's no question these women are

[6:06] heroes. But are they in harm's way

[6:07] because the strict rules about women in

[6:09] combat are being ignored to fight this

[6:11] war? We'll have a fair and balanced look

[6:13] this Saturday at 4 Eastern on Fox News

[6:16] Live.

[6:21] Hi there, I'm Janice Dean with your Fox

[6:23] Cast. What a winter storm we have had

[6:26] over the past several days. And finally,

[6:28] this would be the last day we're going

[6:30] to see this guy and then he's going to

[6:32] push up into Canada. The cold front

[6:34] pushing out to sea. Then we're going to

[6:36] have to watch because we could see a

[6:37] developing low pressure system off that

[6:39] cold front. But let's talk about what's

[6:40] going on right now. And we still have

[6:42] the snow across the Great Lakes. And

[6:44] that cold front associated with it is

[6:46] going to possibly give us some severe

[6:48] weather. We've gotten reports outside of

[6:51] Pennsylvania or around the Pittsburgh

[6:53] area of very dangerous winds consist

[6:56] consistently blowing at 50 miles plus.

[6:59] So, we're going to see a lot of straight

[7:01] line wind damage as we head through the

[7:03] hours. We had tornado warnings earlier

[7:05] on around the Pittsburgh area and that

[7:08] dangerous line continues to push through

[7:10] Pennsylvania. The snow continues to fly

[7:13] across portions of Michigan. Chicago

[7:15] tapering off and they are now allowing

[7:18] some arrivals at Chicago's O'Hare. But

[7:22] some departures are still delayed. All

[7:24] departures still delayed. We'll keep you

[7:25] up to date on that situation. Traveling

[7:27] still very treacherous all up and down

[7:29] the I95 corridor because of those severe

[7:32] storms. The possibility for

[7:33] thunderstorms, large hail, damaging

[7:35] winds, and tornadoes as we head through

[7:37] the afternoon hours anywhere from

[7:39] Raleigh up through Boston. And you can

[7:41] see that dangerous line going through

[7:43] central Pennsylvania right now. Uh some

[7:45] of the reds and the yellows bringing

[7:46] with it lots of heavy rain and the

[7:48] possibility of hail and already reports

[7:51] of damage because of straight line

[7:52] winds. There's the cold side of this

[7:54] storm which brought those temperatures

[7:56] down in some cases 50° in just a matter

[7:59] of hours. And that snow continues to

[8:01] fall. We could see anywhere from 12 to

[8:03] 18 in once this storm is done. I'm Janna

[8:07] Steen. That's your Fox Cast.

[8:14] Hi everybody, I'm Jane Skinner. The

[8:16] Roman Catholic Arch Dascese of Los

[8:18] Angeles has agreed to pay $60 million to

[8:20] settle 45 sex abuse lawsuits. The cases

[8:23] are among more than 500 pending against

[8:25] the arch dasis. It's the largest arch

[8:27] dasis in the country. Negotiations have

[8:29] been going on for at least a year. Well,

[8:31] safety violations are being blamed for a

[8:33] deadly underground explosion at a

[8:35] Kentucky mine back in May. Investigators

[8:37] say the violations include the use of an

[8:39] open flamed torch near a leaky methane

[8:42] seal. They say the protective seal was

[8:44] poorly constructed and failed to meet

[8:46] federal guidelines. That blast killed

[8:48] five minors. In South Korea,

[8:51] demonstration turned ugly over

[8:52] controversial new labor laws. Protesters

[8:54] in Seoul used big sticks to attack

[8:56] police, forcing them to retreat to their

[8:58] vehicles. The protests eventually were

[9:00] broken up when fire hoses were turned on

[9:01] the mobs. An estimated 3,000 angry

[9:04] workers had taken to the streets in

[9:05] front of the in front of the National

[9:06] Assembly building. And coming up in just

[9:09] about 25 minutes or so, right after the

[9:11] live desk panel, doctors always tell

[9:13] women, you know, prenatal medical

[9:15] medical care is essential to assure a

[9:17] healthy baby. That's before the baby's

[9:19] born. But now, new federal guidelines

[9:21] say women should start taking care of

[9:23] themselves before the baby is even

[9:25] conceived. Does that mean we should be

[9:27] eternally pre-reg? I'm Jane Skinner.

[9:30] We'll have that story in our next hour.

[9:31] Time now to send you back to Uma.

[9:40] >> Jane, thank you. Senator Barack Obama

[9:42] speaking on World AIDS Day. He's making

[9:44] a controversial appearance at Rick

[9:45] Warren's church in Southern California.

[9:47] Some anti-abortion activists are furious

[9:49] about his being there because of Senator

[9:51] Obama's stance on abortion, but the

[9:54] speech is going ahead as planned, and

[9:55] the senator may be more popular than

[9:57] ever before. What's going on here? Juan

[9:59] Williams is a Fox News political

[10:01] contributor and Juan joins us now with

[10:03] some thoughts on Barack Obama's rockstar

[10:05] status it seems in the Democratic party.

[10:08] >> Without a doubt he is the rock star of

[10:10] the moment. He had a tremendous fall. Uh

[10:13] talk about an election that benefited

[10:15] any of the political candidates. And

[10:16] you'd have to say Barack Obama is at the

[10:18] top. He's proven that he can raise

[10:20] money. Uh he had a best-selling book uh

[10:22] number one on the New York Times

[10:24] bestseller list. And now speaking to

[10:26] Rick Warren's church out in California,

[10:28] as you can see live, you see a man who

[10:30] is emerging as a major political force

[10:32] in American life.

[10:33] >> He's emerging as a major political

[10:35] force, yet he doesn't have a long

[10:37] history in government service. And yet

[10:39] that doesn't seem to matter to many

[10:40] folks in the Democratic party.

[10:43] >> Well, I think it does matter. I I think

[10:45] at the moment though, you know, you

[10:46] don't want to get in in get in his way

[10:48] at this point. Uh, and also remember the

[10:50] American media is just enchanted with

[10:52] him because he's a fresh face and he's a

[10:55] counter, don't forget to Hillary

[10:57] Clinton. Hillary Clinton has her own

[10:59] powerful story. She'd be, you know, the

[11:00] first woman to run uh on the Democratic

[11:03] ticket for president, per se, uh, if she

[11:05] was nominated. And so, here's a counter

[11:08] face, someone who is a different story

[11:10] uh, as an African-American, someone

[11:12] who's comes from black and white

[11:14] parentage, someone who's just come into

[11:16] the Senate, didn't have to vote on the

[11:18] war. uh and so he has brings a lot of

[11:21] attributes that are enchanting to uh

[11:23] people who are exact not exactly

[11:24] enchanted by Hillary Clinton.

[11:26] >> Well, it's always makes for interesting

[11:27] television and political fodder. Thank

[11:29] you so much, Juan, for joining us.

[11:31] >> You're welcome.

[11:32] >> And if Senator,

[11:36] if Senator Obama makes his run in 2008,

[11:38] will Hillary Clinton back out? Let's see

[11:41] what today's A-list has to say about all

[11:43] of this. Donald Trump Jr. is joining us.

[11:46] He's with the Trump Organization. Carrie

[11:48] Lucas is the vice president for policy

[11:49] and economics for the Independent

[11:51] Women's Forum. Laura Schwarz is a

[11:53] political analyst and former special

[11:55] assistant to President Clinton. And

[11:56] today's wild card, Judge Andrew

[11:59] Npalitano, our own Fox News senior

[12:01] judicial analyst. Plus, he co-hosts

[12:03] Brian and the Judge on Fox Radio, which

[12:06] airs 9:00 a.m. to noon Monday through

[12:08] Friday. As the wild card, the judge gets

[12:10] the free pass and is allowed to

[12:12] interrupt anyone at any time.

[12:14] >> That could be dangerous.

[12:16] And that differs from normally have.

[12:19] >> Let's talk about the fact that Hillary

[12:21] Clinton in and Barack Obama will will

[12:23] her star dim if he actually throws his

[12:26] hat into the presidential ring. Laura,

[12:27] >> no. You know, and I think Hillary will

[12:29] really make her decision independent of

[12:31] Obama, period. And I think the more

[12:32] candidates for the Democrats in the

[12:34] ring, the better. It'd be great to show

[12:35] the American community that we've got a

[12:37] lot of people on the ticket that are all

[12:38] viable, people searching for solutions

[12:40] for our everyday problems in America.

[12:42] But Obama is a rock star. Absolutely.

[12:44] When you help others, you help yourself.

[12:46] He proved that as he campaigned in the

[12:48] midterms this season. And you know,

[12:50] whenever you do the story about Obama,

[12:52] Hillary comes up. And so when there's a

[12:53] Hillary story, you talk about Obama.

[12:55] >> Now, I know the judge, you have a

[12:56] different viewoint on

[12:57] >> Well, I do have a different viewpoint.

[12:58] The reason he's a rock star now is

[13:00] because he's a new face and he has such

[13:01] a small record. But when you look at the

[13:04] record, you will see a very, very left

[13:07] Democrat, out of tune with what the

[13:09] American public wants. He was not there

[13:11] as Juan Williams said to vote on the

[13:12] war. But the things he has voted on are

[13:15] not the things that interest mainstream

[13:17] America. He voted against the tax cuts.

[13:19] He voted against Sam Alto to be on the

[13:21] Supreme Court. He voted to filibuster

[13:23] Sam Alto. He voted against getting rid

[13:25] of the uh estate tax. This is a left

[13:28] Democrat out of tune with the times.

[13:30] >> But to general America, how do you think

[13:31] they see an Obama candidacy?

[13:33] >> Well, I think that the American public

[13:34] is really just getting to know this this

[13:36] guy and um and there is, you know, he's

[13:38] great uh he has great positives, but a

[13:40] lot of people don't know much about him.

[13:41] And I think as as the judge was saying,

[13:43] as as they learn more, um I think

[13:45] they're going to be a little more

[13:46] concerned. You know, is this a man we

[13:48] really want to put in as

[13:48] commander-in-chief when he only has uh

[13:50] you know, two years of experience in the

[13:52] Senate? It's it's, you know, I think

[13:53] there's going to perspective
